An amendment requires local ballot measures banning recreational marijuana sales to be during a general election in an even-numbered year.

After Colorado Springs City Council voted in January to place a question on the April 2025 municipal ballot repealing Ballot Question 300, a district court judge has ruled the move violates Colorado’s constitution.

According to the ruling, the Colorado Constitution says that municipal marijuana-related ballot items must appear on general election ballots in even-numbered years. The upcoming April municipal election does not meet those requirements.

District Court Judge Hilary Gurney ruled that because the repeal would effectively prohibit retail marijuana stores from operating in the city, the Colorado Constitution did not allow the vote
